1.Introduction

1.1 Yoga Health Connect CIC is a Community Interest Company, limited by guarantee and registered in England and Wales (company number 15409290).  

1.2 Yoga Health Connect CIC will be referred to throughout in this document as YHC.

1.3 Beneficiaries of the work YHC undertakes includes individuals, groups and communities. The objective of YHC is to increase access to yoga, yoga therapy and complementary health, with the aim to improve mental/physical health and social wellbeing, support resilience and foster connectivity to others.  YHC focus is on working with people whose lifestyle factors, health conditions and/or disabilities may affect quality of life, wellbeing and resilience, whilst also reducing the burden on local healthcare systems. 

1.4 YHC works to increase access to yoga practice, therapeutic yoga & yoga therapy where it is beneficial for people to learn yogic techniques, apply the tools of yoga and/or to be part of a community-based yoga group.  YHC supports individuals to identify suitable, person-centred yoga and yoga therapy as a complement to their current health care provision and/or social prescription.  YHC collaborates and partners with other community organisations and healthcare services to help support delivery of YHC services.  YHC advances the field of yoga therapy through public awareness raising and research to better understand the possibilities of what can be achieved through yoga. 

1.5 YHC will safeguard funds and ensure that all payments are made to support and promote the main objectives and purposes of YHC.

1.6 If YHC makes financial surplus it will be used as reinvestment into the community or in furtherance of the social objectives of YHC.  Income from commercial events and wellbeing delivery will in part contribute to a YHC COMMUNITY FUND established to sustain yoga delivery, beyond grant funded subsidised places.

2. Policy Purpose & Principles 

2.1 This Policy has been designed to set out YHC’s terms and conditions regarding: i) postponement and cancellation of events, and ii) partial and full refunds.

2.2 This Policy covers income received by YHC regarding commercial activity, including events.

2.3 This Policy covers any customer who pays for a YHC commercial event.

2.4 YHC commercial events include workshops, courses, or classes offered to the public.

2.5 YHC are committed to creating and maintaining a fair and inclusive environment and no one will be discriminated against for applying for or claiming a refund that is due.

2.6 YHC are committed to ensuring consistency regarding cancellations and refunds regarding income received. 

2.7 All requests for refunds must be made in accordance with this Policy and the Refund Procedure.

2.8 Any refund processed may be subject to a reasonable administrative fee to cover YHC actual costs incurred in processing the cancellation and refund. This fee will not exceed the direct costs YHC have faced.  

2.9 Credit notes are to be taken within 12 months from the date of issue.

2.10 When applying this Policy, a customers’ statutory rights will not be affected.

2.11 This Policy considers relevant legislation and guidance for England and Wales.  All terms are designed to comply with customer rights under the Consumer Rights Act 2015 and fairness and transparency requirements. 

2.12 When YHC undertakes checks to assess customers suitability to attend YHC commercial events, including health checks, it is the customers responsibility to be transparent about their needs and to complete a health questionnaire if required. Neither YHC nor the event yoga teacher/therapist will be responsible where a customer has failed to complete a health questionnaire or declare a health condition and an issue arises as a result.

2.13 If YHC is contracting with another organisation on a commercial basis, separate terms and conditions will apply. 

3. Refund Procedure

3.1 Event cancellation or postponement by YHC

3.1.1 YHC reserves the right to postpone or cancel any event.  In the event of postponement or cancellation, YHC agrees to provide as much notice as is possible.  

3.1.2 If an event is postponed by YHC, bookings will be automatically transferred to the rescheduled date and YHC will communicate the new date/s to the customer.  If the rearranged date cannot be made by the customer, YHC will provide a full refund or a credit note for a future YHC event (at the customer's discretion).  

3.1.3 If an event is cancelled, YHC will provide a full refund or a credit note for a future YHC event (at the customer’s discretion).      

3.1.4 YHC will not be liable for any extra costs customers have incurred (such as travel) unless those costs were specifically discussed and agreed upon at the time of booking.

3.2 Customer cancellations and refunds before the start date of a YHC event

3.2.1 A deposit or the full event price is required once a booking has been accepted. Booking may be accepted in-person or by email/telephone. If a booking is made by email/telephone, the customer has a 14-day period in which to cancel the event booking.  

3.2.2 Written notice (usually by email) of a request for a refund needs to be sent to YHC.  In addition, the customer needs to supply their BACS details so that YHC can undertake the refund.  Refunds will be processed as soon as is reasonably practical and no later than 30 working days after receipt of written cancellation notice.

3.2.3 Any refund processed will incur a reasonable administration fee.  

3.2.4 In the event of customer cancellation of an event booking, refunds are at the discretion of YHC and are subject to a reasonable administration fee.  This does not affect the customers statutory rights.  

3.2 5 Courses: 

3.2.5.1 As a goodwill gesture if a customer cancels a course booking, a refund may be provided if YHC are able to re-sell the space. If YHC re-sell the space, terms and conditions apply and YHC will refund the customer minus a reasonable administrative fee.

  • In exceptional circumstances, once a course has started, the course facilitator or yoga teacher/therapist may determine a customer is not suitable to continue.  In these instances, a refund will be offered minus the price of the session/s attended.  No administration fees will apply. 

  • Once a course has started, the course facilitator or yoga teacher/therapist may determine that a customer is not suitable to continue as there has been a significant omission of information by the customer at the intake stage that affects their suitability for a course.  In these instances, a refund may be offered at the discretion of YHC, minus the price of the session/s attended, any deposit paid, and a reasonable administration fee. 

3.2.5.2 If a customer chooses not to continue with a course for any reason once it has started, no refund will be provided.  If exceptional circumstances apply, at the discretion of YHC, a credit note for a future YHC event may be offered.   

4. Government Restrictions

4.1 If cancellation is required due to government restrictions or requirements, a credit note will be offered for a YHC future event of comparable type and value.  Alternatively, a refund will be issued minus a reasonable administrative fee and any deposit. 

5. Exceptional Circumstances

6. Communicating a Written Request for a Refund

6.1 All requests for refunds must be made in writing (by email) to clare.yhc@gmail.com
